近日,一起罚没事件引起舆论关注。据澎湃新闻报道,2026年1月12日,云南省砚山县江那镇子马社区狮子山小组村民杨某艳花了2960元从生猪市场购进一头毛猪,次日早上宰杀后得猪肉350余斤,拉到村口摆摊售卖,结果还没开张,就被市监局检查。因无法提供动物检疫合格证明和肉品品质检验合格证,市监局认定她经营未经检疫的肉类,违反食品安全法有关规定,没收猪肉,罚款5000元。

按照相关法律法规,私自屠宰生猪并售卖,确实是违法行为。《中华人民共和国动物防疫法》规定,禁止屠宰、经营依法应当检疫而未经检疫或者检疫不合格的动物。《中华人民共和国食品安全法》也规定,禁止生产经营未按规定进行检疫或者检疫不合格的肉类。

不过,杨某艳想去申请检疫,也不可能获批。因为《生猪屠宰管理条例》还规定,国家实行生猪定点屠宰、集中检疫制度;除农村地区个人自宰自食外,任何单位和个人未经定点不得从事生猪屠宰活动。而根据食品安全法的处罚规定,经营未按规定进行检疫或者检疫不合格的肉类,由食品安全监管部门没收违法所得和违法经营的食品,并处货值金额十五倍以上三十倍以下罚款,货值金额不足一万元的,并处十万元以上十五万元以下罚款。

根据当地市监局的行政处罚决定书,杨某艳准备按照均价10.50元/斤的价格销售这批猪肉,350多斤猪肉货值3700多元。按上述处罚标准,应罚款10万元至15万元。据媒体报道,市监局表示考虑到杨某艳属于小摊贩、首次违法、案发后能积极配合调查、主动交代违法事实、家庭经济困难等因素,裁量减轻处罚。

不过,行政执法也不能简单、机械地理解法条。《中华人民共和国行政处罚法》第33条规定,违法行为轻微并及时改正,没有造成危害后果的,不予行政处罚;初次违法且危害后果轻微并及时改正的,可以不予行政处罚。此案中,杨某艳的行为虽然违法,但涉案猪肉尚未销售,没有造成任何危害后果,又是初次违法,完全可以不予处罚,只进行教育。

近年来,类似事件常常出现。有蔬菜店主卖了5斤不合格芹菜,被罚款6.6万元;有农民收了邻居70斤芹菜卖给批发商,赚了14块,因为农残超标被罚款5万元。2024年7月,最高检副检察长张雪樵在新闻发布会上就表示,实践中对一些小摊小贩、小微企业的行政处罚违反“过罚相当”原则,处以高额罚款,既不符合法律精神,又不符合公平正义的要求,也损害了当事人的合法利益,甚至严重影响当事人的生产生活。

据杨某艳自述,其“是文盲不懂相关规定”,原本计划赚点生活费,结果不仅赔了本钱,还要被罚款,让夫妻二人“寝食难安”。5000元罚款加上近3000元购猪款,对当地一个本就生活困难的农村家庭来说,不是一笔小数目。据报道,杨家缴纳的5000元罚款,全部是向亲戚借来的。

保障食品安全的关键当然在于日常监管,但对小商小贩小错重罚、严苛管理,未必能取得理想效果。原因在于,在一定范围内,监管加强会大幅度增加食品安全,但其边际效用是递减的,并不是监管加强多少,食品安全就会增加多少。当监管力度增加到一定的程度,甚至于动辄为了几斤食品与几块钱营业额就开出天价罚单时,监管带来的安全收益已不足以覆盖巨大的监管成本,其成效是事倍功半、得不偿失的。

问题的另一个维度,是现行法规也有修改完善以利民生的必要。按现行法规,要申请设立生猪屠宰定点厂(场)的门槛不低,一些地方甚至要求家禽屠宰也必须定点。这些规定,与传统观念不合,于一些地方的实际情况也难符,民众很容易无意中陷入违法。今年全国两会上,就有全国人大代表提出,大量小型禽类养殖场因无力承担高昂的标准化屠宰成本而陷入“合法成本高、违法风险大”的两难局面。

法规应考虑传统,贴近社情民意,监管也要避免以罚代管、小过重罚。民众本来可以低成本吃到新鲜肉,却因为门槛过高只能去大零售商那里购买,这会推高民生开支,也压缩了市场空间。对生猪屠宰售卖,也不妨降低门槛,允许个人设立小型屠宰点,并为屠宰前的检疫提供便利,让边远农村的民众能吃上鲜肉,也让杨某艳们能自力更生,“赚点生活费”。
