2026 年 5 月 26 日 10:30 左右,洱源县人民医院李医生,在 2 号住院楼六楼外一科工作期间,被患者家属喊至走廊后,强行掐住其后颈部,并推着下楼梯,推至五楼楼梯口处时,被医院工作人员及保安劝止并报警,造成李医生受伤。经诊断为:1.创伤后应激障碍;2.颈部挫伤。
7 月 3 日,云南大理州洱源县人社局公示 2026 年度工伤认定结果,李医生也在其中。
公示称:李某某,男,洱源县人民医院职工。根据《工伤保险条例》第十四条第一款第(三)项“在工作时间和工作场所内,因履行工作职责受到暴力等意外伤害”之规定,属于工伤认定范围,拟认定为工伤。
工伤,是指劳动者在从事职业活动、或者与职业活动有关的活动时,所遭受的不良因素的伤害。
那么,医护人员上班期间遭受暴力伤害算不算工伤?
很显然,算。
根据《工伤保险条例》第十四条规定,职工有下列情形之一的,应当认定为工伤:
(一)在工作时间和工作场所内,因工作原因受到事故伤害的;
(二)工作时间前后在工作场所内,从事与工作有关的预备性或者收尾性工作受到事故伤害的;
(三)在工作时问和工作场所内,因履行工作职责受到暴力等意外伤害的;
(四)患职业病的;
(五)因工外出期问,由于工作原因受到害或者发生事故下落不明的;
(六)在上下班途中,受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故+伤害的;
(七)法律、行政法规-规定应当认定为工伤的其他情形。
只要能证明突发之疾病,为工作中不良因素所导致的伤害,即证明突发疾病与工作有因果关系,即可认定为工伤。
但很多时候,现实中,工伤却很难认定。
因为,谁主张谁举证。有时候,这个举证,并不容易。
你举证超负荷工作了,有多少工作量,一天超过多少小时,有多少手术量,是大量工作。
但认定部门一句话,别人也这么大工作量怎么没有发病?
你举证因工作问题被人肢体伤害。
认定部门反问:别人怎么没有被患者肢体冲突受伤?
还有,比如积水潭医院的烧伤超人阿宝,工作期间被患者无端肢体挑衅,两人发生肢体冲突,阿宝骨折,结果不仅没有认定工伤,反而还被认定互殴,行拘了。
你说。这种情况,上哪说理去。
特别是一些工作岗位猝死的,更不容易认定。
你得死在 48 小时之内。
否则,超时死亡,不算工伤。
比如,天津的王一医生,猝死在医院工作岗位,却因为抢救超过 48 小时后才宣布临床死亡,不予认定工伤。
即便法定时间内死亡,你也得证明你这个疾病,不是自身的疾病因素,而是因为工作导致。
也就是说,你的证明不是内部原因,而是外部因素,才行。
比如,猝死在医院的医生,必须提交证明他本身的身体的情况和他工作的强度,比如说之前有没有熬夜,有没有高血压,身体是不是都非常好。
另外,还要提供猝死的医生工作的强度、做手术的时间长度。比如说已经工作了六个小时,连续做手术了六个小时,而且前几天都有在做手术,没有休息。
只有在这种状况下,才有可能认为因公受到损害,而不是自身的疾病的可能性。
回到本文开头洱源县人民医院李医生一案来看。李医生在医院工作岗位中受到伤害,显然符合“工作时间”和“工作场所”的要求。
