据厦门市湖里区人民法院公告,奢侈品品牌LV近日起诉厦门某楼盘房企与物业公司,该案定于8月10日开庭。
综合大河报、红星新闻等报道,该楼盘以新中式为设计定位,在外立面、入户大堂、景观护栏、楼道镂空等公共区域,运用了对称四叶花卉雕花纹样。
LV方面诉求,判令开发商拆除、替换小区内所有侵权雕花装饰,并赔付经济损失与维权产生的各项合理费用。
对此,楼盘开发商抗辩称,涉案花纹源自传统宝相花、柿蒂纹,是中式园林通用装饰,仅用于景观美化,无意攀附奢侈品牌,不构成商标侵权。这也是LV首次将商标维权延伸至地产建筑领域。
据北京日报26日最新报道,LV内部知情人士透露 ,本案并非因楼盘公共区域装饰纹样与路易威登商标近似而提起诉讼,也并非针对建筑装饰或传统纹样本身,而是相关场所内存在涉嫌销售假冒路易威登商品的行为。
根据案件具体情况,权利人依法主张相关经营主体及物业管理方应承担相应的管理责任和法律责任。该人士表示,本案的核心争议是涉嫌销售假冒商品及相关主体的管理责任,而非楼盘装饰图案,更不存在针对中国传统纹样提起诉讼的情况。

北京知识产权法院5月27日公布了一则公告,定于2026年7月16日公开审理一起涉及路易威登的商标行政纠纷案。该公告是向案件第三人黄民耀送达的公告,案号为(2026)京73行初4727号,原告为路易威登马利蒂,被告为国家知识产权局,黄民耀作为第三人参加诉讼。公告并未披露诉争商标具体信息。
公开裁判文书显示,这已经是LV第六次起诉国家知识产权局。此前5起一审案件中,LV有3起获得法院支持,相关行政决定被撤销,国家知识产权局被要求重新作出决定;另外2起,LV的诉讼请求被法院驳回。
路易威登马利蒂也是此前起诉茉莉奶白商标侵权案的原告。此前,苏州中院宣判路易威登(LV)诉茉莉奶白商标侵权案,认定后者使用的四叶花卉图形侵犯LV7件商标,判茉莉奶白合计赔偿1030万元。
