近日，四川证监局发布行政处罚决定书，对1997年出生的个人投资者孙哲元编造、传播纯碱期货虚假信息的行为作出处罚，合计罚没48.5万元。 经查明，孙哲元存在以下违法事实：
孙哲元控制使用百度百家账号“帝侃”编造多篇关于纯碱生产的虚假文章并公开发布，主要涉及两个虚假信息。
> 一、2023年11月28日编造并传播的虚假信息
> 2023年11月28日16:05:11至18:07:20“帝侃”账号连续发布4篇内容相似的文章，称内蒙古某股份有限公司（以下简称A股份公司）纯碱生产锅炉发生故障，使生产线陷入停滞，修好至少半年。截至2023年11月29日（发布后1日）上述4篇文章在百度百家平台合计阅读量共2061次，其中一篇文章阅读量1749次。
> 二、2023年11月30日编造并传播的虚假信息
> 2023年11月30日20:06:30至20:48:33，“帝侃”账号连续发布13篇内容相似的文章，称阿拉善地震导致A股份公司工厂受损。截至2023年12月1日（发布后1日）上述13篇文章在百度百家平台合计阅读量6733次，其中一篇文章阅读量为2219次。
上述文章都是孙哲元根据网络上有关A股份公司的传闻报道利用AI工具生成并发布，均为虚假信息。相关文章发布后1天的阅读量较大、传播范围较广，有投资者就虚假信息相关内容在深交所互动易平台向A股份公司提问核实情况，有投资者就孙哲元发布虚假信息向12386平台进行举报。后续A股份公司委托律师事务所向孙哲元出具《律师函》，称自2023年起，孙哲元以名为“帝侃”的百度百家账号先后在百度百家编造发布图文、视频虚假信息，要求孙哲元立即停止捏造传播虚假信息。孙哲元编造、传播上述虚假信息的行为对投资者具有明显误导性，扰乱了期货市场。
孙哲元在编造并传播虚假信息期间存在交易纯碱期货合约的行为，扣除手续费交易实际获利85028.85元。
四川证监局决定：对孙哲元没收违法所得85028.85元，并处以40万元罚款。
